The Tribal Biotechnology & Health Consortium today transmitted a formal Sovereign Notice to the Centers for Medicare & Medicaid Services, accompanied by an ECHAGA Corporation Board Resolution, requesting that CMS formally recognize the tribal ownership of HCPCS Q4347 (Rampart™ DL Matrix) in the federal record of covered products.
The Sovereign Notice was issued on behalf of the Pine Ridge Oglala Sioux Tribe — through its IRA Section 17 federal corporation, ECHAGA Corporation, led by President Baptiste “Bat” Pourier and CEO Gary Ruse — and the Blue Lake Rancheria Economic Development Corporation, led by President and Chairman Eric Ramos. The notice articulates the sovereign authority under which the Consortium operates and the federal trust obligations that attach to a tribally owned product in the Medicare system.

What this means for tribal health and tribal nations
A formal Sovereign Notice from federally recognized tribal nations is among the most powerful instruments in the tribal-federal relationship. The Consortium’s use of it on a Medicare coverage matter establishes a precedent: this instrument applies to regulated healthcare products, not only to land and treaty rights. Tribal attorneys and economic development leaders building their own engagements now have that precedent on the federal record.
