Issued by Clear Health Pass Holdings, LLC, as Authorized Tribal Agent

It has come to the attention of Clear Health Pass Holdings, in its capacity as Authorized Tribal Agent for the Tribal Biotechnology & Health Consortium, that certain activities in the marketplace have raised concerns regarding the use of the Rampart™ name and representations made about the tribal sovereign authority governing the Rampart™ DL Matrix product line.

In response, the Consortium has initiated a formal internal review to ensure the integrity of the tribally owned product line is protected and that the sovereign governance structure is properly respected by all market actors.

The Tribal Biotechnology & Health Consortium is the sole sovereign authority over the Rampart™ DL Matrix (HCPCS Q4347) product line. Clear Health Pass Holdings is the sole Authorized Tribal Agent, Exclusive Worldwide Licensee, and IP Administrator for the Consortium. Any representations made in the marketplace inconsistent with this structure do not carry the authority of the Consortium and should not be relied upon by any party.

What this means for tribal health and tribal nations

The protection of tribal IP and tribal sovereign authority is a governance matter, not a commercial one. When a tribally owned product enters the federal marketplace, the tribe must be able to control the use of its name and its sovereign representations. Any erosion of that control sets a precedent affecting every tribal enterprise that follows. The Consortium is acting to make clear the line is firm.
